General Terms and Conditions of Service Provision
- These general terms and conditions of service provision govern the services provided by UAB Viena klinika, legal entity code 305614464 (hereinafter — the Clinic).
- In case of discrepancies between these general terms and any special terms individually agreed with clients, the special terms shall prevail.
- The Clinic undertakes to provide services to the client and to make every effort to ensure that the result of the services matches the client’s expectations as closely as possible.
- The client undertakes to pay the Clinic for the services provided.
- The client confirms that they are aware of and accept the prices for the Clinic’s services as set out in the Clinic’s price list. The client undertakes to pay the Clinic the price of the relevant service as set out in the price list.
- At the client’s request, the Clinic may provide an online consultation together with a visualization (sketch) of the intended outcome of the service, illustrating what the final result would preliminarily look like.
- The provision of a preliminary visualization (sketch) to the client does not constitute the Clinic’s confirmation that the actual result of the services will match the preliminary visualization (sketch). Providing a preliminary visualization (sketch) also does not constitute an obligation on the part of the Clinic to achieve the result shown in the visualization (sketch). The actual result of the services provided to the client may differ from the preliminary visualization (sketch).
- The Clinic shall not be liable to the client if the result of a properly performed service does not meet the client’s subjective expectations.
- The client undertakes to follow all recommendations given by the Clinic, whether verbally, in writing, or in any other form.
- The client confirms that they are aware of and accept that, for the first 3–4 days after the service is provided, the intensity of the pigment color will be 40–60% brighter than the final result. Pigments introduced into the skin typically stabilize within 7 days, but in individual cases may continue to change over a period of 1–3 months. The final color tone depends on individual skin structure and characteristics, as well as natural pigmentation, and therefore the Clinic cannot and does not guarantee the final color tone. The client understands and accepts that the pigment may lighten and change shade over time.
- It has been explained to the client that, in order to achieve the desired result, the procedure may need to be performed several times, usually up to 3 times. A micropigmentation correction will also be required to achieve the final result. This is understood and accepted by the client.
- The client is informed that the shade of the pigment used in the service may change and appear different on the client’s skin than before the start of the procedure, and that, due to individual characteristics of the client’s skin, the client’s skin may reject the pigment entirely or partially, may heal unevenly, and/or may not heal in all areas. The client understands that the Clinic and the specialist providing the service have no influence over and cannot control these changes and processes. The client confirms that, due to these possible changes, the client has no claims and will have no claims in the future against either the Clinic or the specialist who provided the service.
- It has been explained to the client that the result of the services lasts for several years; however, due to individual characteristics of a person’s skin, the pigment may last for different periods of time in different areas, which the Clinic cannot specifically state or guarantee.
- The client undertakes to fill out and submit a client questionnaire to the Clinic before the service is provided. The client confirms that the information provided is accurate and complete.
- The client confirms that they have been informed that services cannot be provided in the following cases:
- 15.1. To pregnant women, unless the client confirms in writing, in advance and prior to the procedure, that she is aware of the risks associated with performing the procedure while pregnant, accepts these risks, and consents to the procedure;
- 15.2. To clients with blood clotting problems;
- 15.3. To minors, unless written parental consent to the procedure is provided in advance, prior to the procedure;
- 15.4. To clients with heart or other organ implants, unless written consent from a physician for the procedure is provided in advance, prior to the procedure.
- The client confirms that the client does not fall under the cases specified in Clause 15 of this Agreement, and that services may therefore be provided to them.
- The client is also informed that the provision of services and the materials used during the procedure may cause an allergic or other undesirable reaction, and that the client must therefore provide the Clinic with full information about any allergies the client has prior to the procedure. The client undertakes to provide this information to the Clinic by completing the client questionnaire. The client confirms that the information provided regarding allergies is accurate and complete.
- The client confirms that they are aware that the provision of services (procedures) may cause side effects such as pain during the procedure, allergic reactions, bruising, swelling, and hardening at the procedure site. The client undertakes not to raise any claims or demands against the Clinic regarding the occurrence of such side effects. Other side effects may also occur due to improper skin care after the service, in cases of non-compliance with the recommendations provided to the client. The Clinic is not liable for the occurrence of such side effects if they are not specified in this clause, or if they occurred due to non-compliance with the recommendations provided to the client.
- The client understands that the price of the services includes, among other things, the cost of materials and supplies required to provide the services, specialists’ remuneration, and other expenses incurred by the Clinic in connection with the provision of services. The client agrees that, if the client acquires the right, on any basis, to demand that the Clinic refund the price paid for the services or compensate for other losses, all expenses incurred by the Clinic in providing the services shall be deducted from the amount payable to the client.
- The Clinic shall not be liable for any damage caused to the client, direct or indirect losses, or injury to health or life suffered by the client, if the client provided false or incomplete information, or if the client failed to follow the skin care instructions provided after the Procedure.
- In all other cases, the Clinic’s financial liability is limited to the amount of money the client paid to the Clinic for the services provided.
PROCESSING OF THE CLIENT’S PERSONAL DATA AND USE OF IMAGE
- The client confirms that they were given the opportunity to review, have reviewed, and agree to the Clinic’s personal data processing procedure in force.
- A client who does not agree to the personal data processing procedure may decline to enter into this Agreement.
- Upon receiving the client’s email contact details, the Clinic may use them to market its services. The client may object to or opt out of such use of contact details for the purposes stated above at any time by notifying the Clinic (by email at info@clinicep.lt). With each message sent, the client is provided with a clear, free, and easily exercisable option to opt out of further messages. The client does not object to such use of data.
- The client also confirms that the Clinic may, at its discretion, use the client’s image in its operations, and use the client’s image for the Clinic’s advertising and marketing purposes, including use of the image on the Clinic’s social media. This confirmation constitutes the consent provided for in Article 2.23(1) of the Civil Code to use, reproduce, and display a person’s photograph. Alternatively, the client may agree that the image be used only in a manner that makes it impossible to identify the client from the image, or may decline to consent to the use of the image altogether.
OTHER PROVISIONS
- This Agreement and the provision of services shall be governed by the law of the Republic of Lithuania.
- The parties undertake to resolve all disputes between them amicably. In fulfilling this obligation, the parties undertake that, in the event of a dispute or if a client is dissatisfied with the quality of services provided, they shall first contact the other party in writing, setting out their position and claims. This obligation also includes the client’s obligation, before posting an assessment, opinion, recommendation, or review on social media or in any other public space, to inform the Clinic of the client’s claims, giving the Clinic a reasonable period of time to provide the client with an explanation or otherwise remedy the situation. The client confirms that they understand that public opinion (including on social media) about the Clinic is of essential importance to the Clinic, and that the publication of any negative assessment, opinion, recommendation, or review, without first giving the Clinic the opportunity to remedy the situation, harms the Clinic’s reputation and causes damage to the Clinic. The client undertakes to compensate for such damage if the Clinic demonstrates that the client’s claims were unfounded.
- All disputes that the parties fail to resolve amicably in accordance with the procedure set out in Clause 27 of this Agreement shall be resolved in the courts of Lithuania, in Vilnius.
